- Transparent: Clear about what is and isn't allowed on our platform
- Educational: Helping users understand why certain content isn't permitted
- Fair: Providing opportunities to appeal decisions you believe were made in error

- Content that promotes, encourages, or provides instructions for suicide or self-harm

- Challenges or dares that encourage dangerous activities that could lead to harm
We do allow content that discusses these topics in educational, documentary, or artistic contexts, particularly when aimed at awareness and prevention.

Copyright & Intellectual Property
Respecting Others' Work
Songtake is committed to protecting copyright and intellectual property rights. We don't allow unauthorized use of copyrighted content, including:
- Uploading music created by others without proper permission or licensing
- Sampling or remixing other artists' work without appropriate rights
- Using trademarked content without authorization
- Providing instructions for circumventing technical copyright protections
- Using backing tracks, loops, or beats without proper licensing
- Uploading cover versions without mechanical licensing when required
For more information about copyright issues, please see our DMCA Policy.
Musical Collaborations
We recognize that music is often collaborative. When collaborating with others on Songtake:
- Be clear about rights ownership before starting collaborative projects
- Obtain explicit permission before remixing or adding to another user's work
- Respect attribution preferences of all contributors
- Do not claim sole ownership of collaboratively created works
- Consider documenting collaboration agreements for significant projects
While Songtake provides tools for collaboration, we cannot mediate rights disputes between collaborators. Clear communication about rights and expectations is the best way to avoid misunderstandings.
Fair Use
We recognize that in some cases, limited use of copyrighted material without permission may be permitted under fair use principles, especially for purposes such as:
- Commentary
- Criticism
- Education
- Parody
Fair use is determined on a case-by-case basis, considering factors such as the purpose of use, the amount used, and the effect on the potential market for the copyrighted work.
In the context of music creation, fair use has specific limitations. For example:
- Short samples may qualify for fair use in certain contexts, but sampling entire hooks or significant portions typically requires licensing
- Creating cover versions typically requires mechanical licensing, regardless of fair use principles
- Educational content about music theory or technique may have stronger fair use claims than purely entertainment content
Misinformation
Harmful Misinformation
We don't allow content that could cause harm by spreading misinformation, especially in these sensitive areas:
- Health and medical misinformation that contradicts established expert consensus
- Content that promotes dangerous remedies, cures, or treatments
- Election integrity and voting misinformation
- Content that promotes conspiracy theories that target vulnerable groups
Enforcement
When content violates our Community Guidelines, we may take one or more of the following actions:
Content Removal
We will remove content that violates our guidelines. When we do, we'll notify the content creator and explain which policy was violated.
Strikes System
Our strikes system helps users understand when they've violated our policies and how the violation impacts their account:
- First Violation: Warning with no penalty (in most cases)
- Strike 1: Temporary restrictions on certain features for 1 week
- Strike 2: Temporary restrictions on certain features for 2 weeks
- Strike 3: Channel termination (within a 90-day period)
Strikes expire 90 days from the date they were issued. However, severe violations may result in immediate channel termination without prior strikes.
Age Restrictions
Content that doesn't violate our Community Guidelines but may not be appropriate for all audiences might be age-restricted. Age-restricted content is not visible to users under 18 years of age or to users who are not logged in.
Educational, Documentary, Scientific, & Artistic Content
We recognize that some content that might otherwise violate our Community Guidelines may be allowed if it has educational, documentary, scientific, or artistic (EDSA) value. When evaluating whether content qualifies for an EDSA exception, we consider:
- The purpose and context of the content
- Whether the controversial elements are necessary to the educational, documentary, scientific, or artistic purpose
- Whether appropriate context and disclaimers are provided
Examples of music-related content that may qualify for EDSA exceptions include:
- Songs that discuss sensitive social issues or historical events with artistic purpose
- Tutorial videos demonstrating instrument techniques that may include copyrighted examples
- Documentary content about music culture or history that contains mature themes
- Music therapy content addressing mental health or medical issues
- Academic analyses of musical compositions or performances
