Songtake doesn't collect user passwords for login and instead utilizes:

• Email magic sign-in links
• SMS authentication

If you choose to enable two-factor authentication, we may collect additional information related to your chosen verification method.

User Content

When you use our Application, we collect and store:

• Audio recordings
• Video recordings
• Project files and metadata
• Images (including avatar images and project covers)
• Other files you upload to our service

3. Storage and Data Security

Songtake implements various security measures to protect your data:

• All user data is encrypted using AES-256 encryption when in cold storage
• Data in transit is protected using SSL/TLS encryption
• Storage allocation is based on subscription tier:
  • Free plan: 250MB
  • Studio Access: 1TB
  • Patrons: 1.5TB
• The app is designed to function offline, with local data synchronized to our servers when an internet connection is available

Your Content ("Your Stuff")

Our Services are designed as a simple and personalized way for you to store your files, audio recordings, videos, lyrics, and other content ("Your Stuff"), collaborate with others, and work across multiple devices. To make that possible, we store, process, and transmit Your Stuff as well as information related to it. This related information includes your profile information that makes it easier to collaborate and share Your Stuff with others, as well as things like file size, upload time, collaborators, and usage activity.

For multi-track music projects, we may process your content to:

• Generate waveform visualizations of audio tracks
• Create video thumbnails and previews
• Synchronize multiple audio and video tracks
• Detect tempo and musical key information
• Optimize file formats for playback on different devices
• Create compilation exports of multi-track projects

Security Team

We have a team dedicated to keeping your information secure and testing for vulnerabilities. We continue to work on features to keep your information safe in addition to things like two-factor authentication, encryption of files at rest, and alerts when new devices are linked to your account. We deploy automated technologies to detect abusive behavior and content that may harm our Services, you, or other users.

Global Infrastructure

To provide you with the Services, we may store, process, and transmit data in the United States and locations around the world—including those outside your country. Data may also be stored locally on the devices you use to access the Services. When transferring data from the European Union, the European Economic Area, the United Kingdom, and Switzerland, Songtake relies upon a variety of legal mechanisms, including contracts with our users and Standard Contractual Clauses.

Stewardship of Your Data

Stewardship of your data is critical to us and a responsibility that we embrace. We believe that your data should receive the same legal protections regardless of whether it's stored on our Services or on your home computer's hard drive. 4. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with our services. Our specific data retention policies include:

• If you cancel a paid subscription (Studio Access or Patron), we will keep your data in cold storage for a minimum grace period of 6 months
• We may delete free tier accounts that have been idle for more than 6 months
• We may delete free tier accounts that appear suspicious or potentially abusive

You can request deletion of your data at any time by contacting us.

Account Deletion

When you delete your account, we'll initiate deletion of your information after 30 days. Please note: (1) there might be some latency in deleting this information from our servers and back-up storage; and (2) we may retain this information if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

User Controls

You can access, amend, download, and delete your personal information by logging into your Songtake account and going to your account settings. You can:

• Delete Your Stuff in your Songtake account
• Change or correct personal data through your account settings
• Access and take your data elsewhere by downloading a copy of Your Stuff in a machine-readable format
• Request that we stop or limit processing of your personal data

5. Sharing of Information

When You Agree or Direct Us to Share

We'll share your information with third parties when you give us explicit permission to do so. For example, when you choose to share files or content with others, we'll need to make that content available to those people.

Legal Compliance and Law Enforcement Requests

We may disclose personal information if we determine that disclosure is reasonably necessary to comply with the law, protect our or others' rights, property, or safety, or enforce our Terms of Service. • Edge Locations: Brazil, Germany, and Singapore for services such as upload acceleration and download cache

Rather than implementing direct age verification during account creation, we rely on the age restrictions set by the Apple App Store and Google Play Store to prevent users under 13 from downloading our application.

If we discover that a child under 13 has provided us with personal information despite these measures, we will immediately:

• Delete that information from our servers
• Terminate the child's account if one was created
• Notify parents or guardians as required by COPPA

EXCEPT WHERE PROHIBITED BY LAW, RIDICULOUS, LLC WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, LOSSES, EXPENSES, OR COSTS YOU MAY SUFFER AS A RESULT OF A SECURITY BREACH, DATA INCIDENT, OR OTHER SECURITY EVENT, EXCEPT TO THE EXTENT THAT SUCH LIABILITY ARISES FROM OUR FAILURE TO COMPLY WITH APPLICABLE LAWS. OUR MAXIMUM LIABILITY FOR ANY SECURITY EVENT SHALL BE LIMITED TO THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRIOR TO THE EVENT.
